Terms and Conditions

These terms are an agreement between you and RxPlanMatch ("we", "us"), the provider of the RxPlanMatch service at https://rxplanmatch.com. By creating an account or continuing to use the service you agree to them.

1. Who you are contracting with

The service is provided by RxPlanMatch, trading as RxPlanMatch. Questions about these terms can be sent to fuller413@proton.me.

If you use the service on behalf of an agency or other organisation, you confirm you have authority to bind that organisation. If you use it as an individual, you confirm you are of legal age to enter a contract.

2. What the service does

RxPlanMatch lets insurance agents and agencies collect prescription drug lists from clients, read those lists automatically, and compare stand-alone Medicare Part D prescription drug plans using official Centers for Medicare & Medicaid Services plan and formulary data loaded into the system. Results show the two least expensive matching plans and link to the plan page on Medicare.gov, where enrollment takes place.

RxPlanMatch is not a government website, is not Medicare.gov, and is not affiliated with or endorsed by any government agency. Costs shown are estimates for comparison only, and they are not financial, insurance, legal, tax or medical advice. For all available plans, visit Medicare.gov, call 1-800-MEDICARE, or contact your local SHIP/SHIIP office. You are responsible for your own compliance with Medicare marketing rules and with the licensing and suitability obligations that apply to your business.

3. Accounts and accuracy

You must provide accurate account information and keep it current. You are responsible for keeping your login credentials confidential and for all activity carried out under your account.

4. Licence and restrictions

We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have selected, for your own agency business. You must not:

  • reverse engineer, decompile or copy the service or its underlying software
  • resell, sublicense or redistribute the service or its output as a competing product
  • circumvent usage limits, seat limits, trial limits or other technical controls

5. Acceptable use

You must not misuse the service. In particular, you must not:

  • use it for any unlawful purpose, or in breach of Medicare marketing, privacy or insurance regulations
  • commit fraud, send spam, or send intake invitations to people who have not agreed to hear from you
  • infringe anyone's intellectual property or privacy rights
  • interfere with the security or integrity of the service, including uploading malware, probing, scanning, load testing or scraping
  • upload client health or prescription information you are not permitted to process

6. Automated extraction and generated output

The service uses automated and AI-based processing to read drug names, strengths and dosages from the documents, photos and notes you or your clients submit, and to produce plan comparisons.

  • You are responsible for what you submit, including having the right and any necessary consent to submit client documents and prescription information.
  • Extracted drug lists and plan comparisons may be inaccurate or incomplete. You must review them, and neither they nor any other output is a substitute for professional judgement or for confirming details on Medicare.gov or with the plan.
  • You must not submit unlawful content, or use the service to create misleading or deceptive materials.
  • You keep the rights in the content you submit and grant us a limited licence to host and process it solely to provide the service. Output generated for you is yours to use in your business, subject to these terms.
  • If a rights holder believes content in the service infringes their rights, they can contact us at the address above and we will review and, where appropriate, remove it. Repeat or serious infringement can result in termination.
  • We may remove or restrict content, refuse or filter output, and suspend accounts where content or use breaches these terms.

7. Payment, subscriptions and taxes

Subscriptions are sold as yearly plans at the prices shown on the pricing and billing pages. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing frequency, renewal, tax, invoicing, cancellation and refund mechanics are governed by Paddle's Checkout Buyer Terms. Subscriptions renew for a further term unless cancelled. If you cancel, your access continues until the end of the period you have paid for, and then reverts to trial limits. If you change plans, the change applies immediately and the price difference is pro-rated.

8. Service level

We work to keep the service available, but we do not guarantee uninterrupted or error-free performance. Maintenance, third-party outages and updates to official plan data can affect availability and results.

9. Intellectual property

We retain ownership of the service and all intellectual property in it, including the software, interfaces, documentation and branding. Official Medicare plan data remains the property of its publisher.

10. Suspension and termination

We may suspend or terminate access where there is a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. Where it is reasonable to do so, we will tell you first and give you a chance to fix the problem.

When access ends you can ask us to export your stored comparisons and client records within 30 days, after which data may be deleted.

11. Warranties and liability

To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including lost profits, lost data, lost commissions or loss of goodwill. Our total liability is limited to the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury, or any other liability that cannot be excluded by law.

You indemnify us against claims arising from the content you submit, your unlawful or non-compliant use of the service, or your breach of these terms.

12. Changes to these terms

We may update these terms. Material changes will be notified by email or in the app, and continued use after the change takes effect means you accept the updated terms.

13. General

These terms are governed by the laws of the United States and the state in which RxPlanMatch is established, and disputes will be heard by the courts of that state. You may not assign this agreement without our consent; we may assign it as part of a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
